Der Bieter hat folgende Unterlagen auf gesondertes Verlangen innerhalb der gesetzten angemessenen Frist vorzulegen:

— Gewerbeanmeldung, Handelsregisterauszug und Eintragung in die Handwerksrolle bzw. bei der Industrie- und Handelskammer des Sitzes oder Wohnsitzes oder vergleichbar, soweit die Eintragung in das Register nach den gesetzlichen Bestimmungen des Mitgliedstaates, in dem der Bewerber seinen Sitz hat, vorgeschrieben ist,

— Unbedenklichkeitsbescheinigung der Berufsgenossenschaft des zuständigen Versicherungsträgers mit Angabe der Lohnsummen,

— Unbedenklichkeitsbescheinigung der tariflichen Sozialkassen, soweit der Betrieb beitragspflichtig ist,

Für bietende Unternehmen, die ihren Firmensitz nicht in der Bundesrepublik Deutschland haben, gilt die Vorlage gleichwertiger Bescheinigungen nach Maßgabe der Rechtsvorschriften des Landes, in dem das Unter-nehmen ansässig ist. Gelangt das Angebot in die engere Wahl, sind Eigenerklärungen (auch die der benannten anderen Unternehmen) auf gesondertes Verlangen durch Vorlage der genannten Bescheinigungen zuständiger Stellen zu bestätigen. Bescheinigungen, die nicht in deutscher Sprache abgefasst sind, ist eine Übersetzung in die deutsche Sprache beizufügen.

Die Vergabestelle ist berechtigt, weitere Auskünfte betreffend die Eignung des Bewerbers auch durch eine auf die Vergabe bezogene Nachfrage beim Gewerbezentralregister einzuholen. Bei ausländischen Bewerbern ist die Vergabestelle berechtigt, im Herkunftsland des Bewerbers entsprechende Auskünfte einzuholen.

— Umsatz des Bieters/der Bietergemeinschaft in den letzten 3 abgeschlossenen Geschäftsjahren, soweit er Leistungen betrifft, die mit der zu vergebenden Leistung vergleichbar sind unter Einschluss des Anteils bei gemeinsam mit anderen Unternehmen ausgeführten Leistungen.

— Aufträge werden nur an Unternehmen vergeben, die während des gesamten Leistungszeitraums über eine die vertraglichen Leistungen abdeckende Haftpflichtversicherung mit einer Mindestdeckungssumme je Schadensereignis in Höhe von 1 Mio. EUR für Sachschäden und 3 Mio. EUR für Personenschäden verfügen. Die Versicherung ist bei einem in der Bundesrepublik Deutschland zugelassenen Versicherungsunternehmen abzuschließen. Im Auftragsfall ist dem Auftraggeber ein entsprechend gültiger Nachweis vorzulegen.

— Angabe, welche Teile des Auftrags der Unternehmer unter Umständen als Unteraufträge zu vergeben beabsichtigt. Bei Einsatz von Nachunternehmen sind auf gesondertes Verlangen die Eigenerklärungen auch für diese abzugeben. Sind die Nachunternehmen präqualifiziert, reicht die Angabe der Nummer, unter der diese in der Liste des Vereins für die Präqualifikation von Bauunternehmen e. V. (Präqualifikationsverzeichnis) geführt werden,

— Erklärung des Bewerbers über die Bildung von Bewerber-/Bietergemeinschaften. Bei Bewerber-/Bietergemeinschaften ist von jedem Mitglied die Eignung bezogen auf die jeweils vorgesehene Aufgabe in der Gemeinschaft separat nachzuweisen,

— Beabsichtigt ein Bewerber/eine Bewerbergemeinschaft Kapazitäten anderer Unternehmen als Eignungsleihe gemäß § 6d EU VOB/A zu nutzen, muss er für jedes einzelne in Anspruch genommene Unternehmen eine Verpflichtungserklärung vorlegen, wonach die zur Verfügung gestellten Kapazitäten dem Bewerber/Bieter für die Ausführung des konkreten Auftrags auch tatsächlich zur Verfügung gestellt werden. Bei Eignungsleihe ist mit Abgabe des Angebotes von jedem Eignungsgeber dessen Eignung bezogen auf den jeweilig ausgeführten Leistungsbereich nachzuweisen.

— Referenzliste über 5 vergleichbare auftragsbezogene Referenzen, insbesondere in Hinblick auf Schaltanlagen mit einer Spannung von 12 bis 36 kV der letzten 5 abgeschlossenen Kalenderjahre. Geforderte Angaben: Projektbezeichnung, Auftraggeber (Name/Anschrift/Kontaktdaten), Ausführungszeitraum, Auftragssumme, Projektgegenstand.

Verfahrenssprache ist Deutsch. Das Angebot ist in deutscher Sprache abzufassen. Mit der Abgabe des Angebotes erklärt der Bieter, dass alle am Verfahren Beteiligten des eigenen Unternehmens sowie die beteiligten Beschäftigten etwaiger benannter Nachunternehmen der deutschen Sprache ausreichend mächtig sind und eine reibungslose Kommunikation zwischen ihnen und dem Auftraggeber auf Deutsch erfolgen kann.

Das deutsche Vergaberecht regelt die Frist für die Einlegung von Rechtsbehelfen in §160 Absatz 3 GWB.
